Original PDRMN Constitution

The PDRMN Constitution is a living document, but the original version is still in the Archive and highly regarded. Written by a couple dozen citizens of Utopia over 200 years ago, it has its flaws, but with the system built up around it, it has allowed for the creation of a reasonably solid state.

Purpose

The original constitution lays out the original Martian government. It was a simple system, and only ruled over just over 1300 people in total, for which is it honestly overdesigned. However, they wished to ensure the system would last, and it more or less did.
The system it set up is very familiar to those of earth. A bicameral legislature, a prime minster and cabinet are familiar to most democracies. The martian system was set up more to smooth over a lot of things that the well educated small group of martians disliked.
The government itself was tiny. Other than the parliament, which had 50 members, there were around 20 other people in the government, including the 5 senators, 3 supreme court judges (who were the only 3 judges and 3 of the 5 legally trained proffesionals in the nation), 1 attorney general, and 15 other people that took on governmental roles. Every single department (all 12), was staffed nearly exclusivly by members of parliament.

The Constitution of the People's Democratic Republic of Mars, English
We, the people of Mars, with responsibility of our future and faith in fundamental human nature,

with determination to build a social, free and directly democratic state based on the will of the people and the rule of law, and to
guarantee the fundamental human rights and freedoms,
with a spirit of coexistence and tolerance of all people,
with a pledge to protect human dignity and personhood, as well as for the prosperity of all Martian people, for peace, well-being, culture and social solidarity,
with a deep conviction that justice, peace, harmony and cooperation between nations are among the highest values of humanity, and that democracy is the highest form of government,
with an acknowledgment of the dichotomy the Outer Space treaty and the fundamental human desire to explore and settle

establish this Constitution for the Martian People:

Article 1, On the Nature of the State:

• The PDRM is fundamentally a democratic republic, with frequent, periodic, equal and free representation in governance from all its citizenry.

Article 2, On the Sovereignty of the State:

• The sovereignty of the PDRM belongs completely and exclusively to the citizens.
• The citizens exercise sovereignty directly or through their representatives.

Article 3, On the People's Territory:

• The People's Territory consists of the territory within 100 km of 43 N, 140 E, encompassing the settlement of Utopia and all surrounding areas.

Article 4, On the Use of the People's Territory:

• The People's Territory is the exclusive domain of the Peoples Democratic Republic of Mars, and no other state may lay claim to it. No foreign state may explore, exploit, occupy or otherwise use the People's Territory. The only law applicable within the People's Territory is that of the PDRM. The People's Democratic Republic of Mars may use the People's territory for any purpose it wishes, including the creation of military bases, installations and fortifications, the testing of weapons and the conduct of military maneuvers.

Article 5, On the Unity of the People's Territory:

• The People's Territory is a single economic, currency and customs area. No barriers to trade, free movement of people or tariffs may be established within the territory of the PDRM.

Article 6, On the Capital:

• The Capital of the PDRM is the settlement of Utopia. Under extraordinary circumstances, and under the approval of the Parliament and Senate, the President may temporarily relocate the capital to another area inside the People's Territory.

Article 7, On the Rights and Responsibilities of a Space-borne Nation:

• The People's Democratic Republic of Mars bears the full responsibility of its actions. It also retains jurisdiction over all objects launched into outer space from its territory, or any objects in space carrying PDRM Registration. The PDRM may disregard the interests of foreign powers and may avoid international consultation on any matters taking place entirely or solely within the People’s territory. The PDRM may refuse the right of observation of its space objects by foreign powers and may refuse entry to representatives of foreign powers. The PDRM may perform any act inside its own territory without informing the secretary-general of the United Nations of Earth.

Article 8, On the Rights of all Humans:

• Every human being has a right to life, liberty, security of person, legal representation, and self-determination, and may not be enslaved, be held in indentured servitude, subjected to cruel or unusual punishment, be arbitrarily arrested or detained, arbitrarily interfered with in private matters or correspondence, or be found guilty without a fair trial.

Article 9, On the Rights of Citizens:

• The Republic citizens are equal, without regard for any factor.
• Any citizen of the PDRM may at any time voluntarily revoke their citizenship, and leave the PDRM, and any citizen of the PDRM can not and shall not be banned from entering the PDRM. No citizen can be arbitrarily or en masse striped of their citizenship or rights and will automatically pass on their citizenship to their children if the children are born in the People's Territory.
• Every Citizen has the right to food, shelter, water, oxygen, medical care, entertainment, communication, and travel, to a reasonable limit, to be provided by the Republic. Every Citizen must be given some small amount of local or internal currency that can be exchanged for goods, services, or additional allocations of resources beyond that needed for the enjoyment of life.
• No entity may not deprive any Citizen of their life, except in cases of a reasonable, necessary and measured defense of another person's life.
• No entity may enslave a Citizen, forcing them to work without compensation and with no escape. The PDRM may offer, as opposed to jail time, a period of community service, but the Citizen may leave at any time to serve their jail term.
• No entity may deprive any Citizen of their liberty, except in the execution of an order of a court, for the purposes of bring that citizen to court (where it is limited to 24 hours without a court order), for the purposes of preventing the spread of a disease or pathogen, for the purposes of the care and treatment of a person of unsound mind, for the purposes of effecting the expulsion of a person from the PDRM, or for person under 10 years old, for the purposes of education and welfare.

Article 10, On the Responsibilities of Citizens:

• The fundamental right and responsibility of every citizen is to vote and must do so in elections of the parliament and senate.
• Every Citizen must follow the law of the PDRM, the law of their settlement, and the law of society, and in case of disagreement, follow that of the PDRM over other sources.
• Every Citizen must respect and follow local laws wherever they travel.
• Every Citizen must pay any taxes required.
• Every Citizen should attempt to be as fair and unbiased in interactions with all people. regardless of citizenship, race, ethnicity, gender, manner of birth, sex, religion, language, birthplace, political or other affiliation, property, wealth, or status. All citizens should attempt to accommodate, to a reasonable limit, any expression of any of the above categories, including public demonstrations, modes of address, or attire.
• Any Martian citizen may, under exceptional circumstances, be called to serve the PDRM in some capacity. If the citizen can demonstrate religious or personal reasoning for an inability to perform the necessary actions, they may be given some alternate form of work.

Article 11, On the Governance of the Republic:

• The People's Democratic Republic of Mars will be governed by three entities, the Senate of the PDRM, the Parliament of the PDRM and the People of the PDRM.
  
• The Senate shall be created as outlined in Article 12.
  
• The Parliament shall be created as outlined in Article 14.
  
• The representatives of the citizens in both the Senate and Parliament must be voting age, voting citizens. They cannot have committed a serious offence. They cannot be citizens of or have sworn allegiance to a foreign power. They will be compensated for each day they attend and vote in their respective bodies.
  
• All debates, discussions and meetings within either house must be recorded for free public use, except as outlined in Article 26.
  
• Voting within the Houses shall be performed simultaneously, with votes being public. All Representatives in attendance must vote Yes or No or may deliberately Abstain. No Representative may vote twice.
  
• In extraordinary circumstances, a Representative may vote remotely, but this must be approved by 1/3 of their respective house.
  
• The People of the PDRM are described in Article 16.

Article 12, On Election:

• For any promotion of one candidate over any other, a record must be taken by the candidate being promoted of the amount spent on the promotion.
  
• This must be totaled by the candidate immediately after the election and must not exceed $1,000.
  
• Every Political party may allocate an additional $4,000 to be split amongst whichever candidates it sees fit, and does not count towards the above cap. This will be provided after it wins at least 3 combined seats in either house.
  
• All money spent on the promotion of a candidate must come from a pool provided by the government. It will be audited and may only be spent on promotion and other directly campaign related costs.
  
• A full and honest analysis of campaign spending must be provided for the entire election period upon request and must be available for 10 years after the election.
  
• Candidates must be given an equal weighting and representation in all government sponsored media.

Article 13, On the Senate:

• The Senate of the People's Democratic Republic of Mars shall be composed of 5 representation. These representatives must be chosen democratically by the people of the PDRMN and must run for re-election at least once every 6 Martian years.
  
• The senate must, every 6 months, appoint a team of 3 trusted, impartial auditors to review all the accounts of the Republic, and produce a report detailing all expenses, incomes, deficits, profits and anomalies.
  
• The senate must, every 6 months, have a meeting where more than 50% of the members are present.
  
• The senate must review the laws passed by the parliament.
  
• If any of these conditions are not met, the senate will be reformed, with every member requiring re-election.

Article 14, On the President:

• The President of the People's Democratic Republic of Mars shall be the head of state and shall be elected from and by the senate preferentially. A 4/5 approval in the Senate or 2/3 of the People may remove the President. The President may veto a decision of the Senate that receives less than 4/5 approval. The President shall represent the unity and legitimacy of the People's Democratic Republic of Mars. The President may appoint any one sitting members of the senate to take any bureaucratic or civil leadership role within the government. Any President may serve only a single two Martian year term consecutively and must wait at least 4 Martian years before running for re-election.

Article 15, On the Parliament:

• The Parliament shall be composed of one representative for every 2% of the population. They shall be democratically elected by the entire population of Mars based on their parties. Every citizen of Mars must select a running party to contribute their vote towards, and for every 2% of the population that votes for a party, that party shall receive one seat in Parliament. A party must consist of at least one citizen of the PDRM who is eligible to sit on the Parliament. Any additional chunks of vote that cannot be allocated due to scale or lack of eligible candidates may be donated to another party. The parliament shall be reelected in its entirety whenever its prime minister term ends.

Article 16, On the Prime Minister:

• The Prime Minister of the People's Democratic Republic of Mars shall be the head of the government and will be elected from and by the Parliament preferentially. A 2/3 approval in the Parliament may remove the sitting Prime Minister. The Prime Minister may veto a decision of the Parliament that gains less than 2/3 approval. The Prime Minister may select other sitting members of the Parliament to take bureaucratic and civil leadership roles within the government, except those taken by the President's appointment. A prime minister may choose to end their term early, which triggers a reelection of the parliament, as does the removal of the Prime Minister by the sitting Parliament.

Article 17, On Consultation of the People:

• The People of the PDRM are simply the voting citizens of the PDRM. They may be polled after a petition receiving greater than 1% of the population's signatures, or with the insistence of at least 10% of either house. Any decisions made by the People automatically overturn any decisions made by either house, except for those regarding the Constitution.
• The People must be polled with regard to any major decisions involving the declaration of states of hostilities, the addition of a new settlement into the PDRM, or the termination of the term of the sitting Prime Minister or President.

Article 18, On the Supreme Court:

• The Supreme Court of Mars shall be the final arbiter of all cases, disputes and disagreements in the PDRM, and shall be composed of no less than 5 and no more than 13 voting citizens who have excellent legal comprehension and understanding. They shall be elected for 10-year terms by the legally literate body of Mars and must be approved by the Prime Minister and President.
• The Supreme Court of Mars shall appoint a trusted lawyer to act as an attorney general, who shall advise the government on legal matters. They may serve as long as the supreme court supports them.

Article 19, On the Creation of Laws:

• Any sitting member of the parliment may at any time propose a bill for eventual formation into a law.
  
• This bill must be deliberated upon and for at least 3 working days in the parliament, after which it shall be voted upon.
  
• If the bill receives 3/5 of the vote of the attending representatives, it may continue to the senate, for additional deliberation for 3 days, after which it is voted on again.
  
• If the bill does not pass the initial vote, it will be discarded, and may not be brought back for consideration for at least 30 days. A meaningful modification to the bill may be brought in for consideration instantly.
  
• If a bill passes both houses with 3/5 of the vote of the attending representatives, it then goes before the Prime Minister and President, who may veto the bill. If this happens, the bill goes through the process again, but must receive at least 2/3 of the vote in both houses to pass.
  
• If it is approved by both houses and both heads, it becomes a law, is given a title. This law shall be deposited in the archive of the PDRM and shall be enforced across the entirety of the PDRM territory as applicable.

Article 20, On Changing the Constitution:

• Changes may be made to update sections to modern circumstances of this Constitution, but no changes may ever be made to Articles 1, 2, 4, 5, 7, 9, 11, 12, 14, 16, 17, 18, 19, 20, 22, 23, or 24 without the support of 5/6 of the Senate, Parliament, Supreme Court, and People.
  
• Any other changes require the approval of 2/3 of the Parliament, Senate, Supreme Court, and People, and may be vetoed by the President or Prime Minister.

Article 21, On Language:

• The Republic shall make every effort to accommodate any language spoken by its citizenry, but only English will be guaranteed to be available.
  
• All official laws, standards and statements of the government will be published in English.
  
• All discussion in the Senate and Parliament must take place in English, unless special accommodation is made for extraordinary circumstances.
  
• All court discussion must be conducted in English, except for witness testimonials and other evidence. A translator must be provided for these materials.

Article 22, On Education:

• Every PDRM Citizen has a right and responsibility to be educated.
  
• Such education shall be provided freely and openly and is compulsory for the first 8 years of a Citizen's life.
  Such education shall be unbiased, secular, and teach at least one of the 6 languages.
  
• Additional education outside of government schools is permitted but may not teach proveable false things.

Article 23, On Religion:

• The People's Democratic Republic of Mars is a secular republic and may not favour any religious institution over any other.
  
• The People’s Democratic Republic of Mars may never make a law that benefits one religious’ point of view over another.
• All religious institutions shall be free from any interference by the republic, except in cases where a law is broken, and may not interfere with the republic.
  
• The Government will not make any statements supporting or discrediting any religious or atheistic beliefs that are not based on observable phenomena.

Article 24, On Detention:

• A Citizen of the PDRM may only be detained as specified in Article 9.
  
• While detained, a citizen of the PDRM must have access to all the amenities necessary for the enjoyment of life except for unrestricted freedom.
  
• A citizen may optionally perform some kind of work that may be performed from within a prison and must be compensated the full amount that would normally be provided for that work.
  
• Any money the citizen would normally receive from the government will not be available to that citizen and will be returned to the government.
  
• If a citizen is found to have been falsely imprisoned or detained for any length of time beyond 24 hours, they will be financially compensated at quadruple the yearly monetary stipend allocated to each citizen for each year or fraction thereof imprisoned.

Article 25, On Governance:

• The PDRM shall be run by a collection of bodies refereed to as the Departments. Each shall have a representative of the Parliament as the Minister of the Department, except 1 as chosen by the President.
  
• The Ministers of the Departments shall together be called the Cabinet of the PDRM.
  
• These Departments shall be:
  
• Department of Business and Industry
  
• Department of Defence
  
• Department of Earth Relations
  
• Department of Education
  
• Department of Social Security
  
• Department of Energy
  
• Department of Food
  
• Department of Health
  
• Department of Housing
  
• Department of Law and Order
  
• Department of Legal Affairs
  
• Department of the Treasury

Each of these Departments shall be staffed by trusted citizens of the PDRM and undertake actions to fulfill their duties as outlined by the Government.

A new Department may be formed with the approval of 2/3 of both houses, along with a detailed description of the Department's roles, powers and responsibilities. A department may be dissolved or modified in a similar manner.

Every Department shall have a document, detailing the roles, powers and responsibilities of the Department. Each Department will be given a share of the Governmental budget to perform their duties and shall always act in the best interest of the PDRM.

Any decision or action made or taken by any department may be reverted or declared invalid by a 2/3 majority in either house. Upon such an event, the staff involved would be brought before an inquiry composed of at least 2 members from each house and the Minister of the Department, who shall then decide, through simple majority, if the staff were justified in their decision or actions. If the decision or action involved the Minister of the Department, the inquiry will be composed of at least 3 members of each house, and the Prime Minister.

Article 26, On the Rights of Representatives:

• Representatives shall receive certain rights not extended to the rest of the population to allow them to efficiently and effectively perform their duties.
  
• Representatives shall receive, in addition to their government mandated basic income, a sum not exceeding 200% of the average daily salary for the population of the PDRM for each day in which they appear and vote in their respective house.
  
• Representatives shall not be detained for any reason except in criminal cases, while serving their elected term.
  
• No statement made in either house may be used in a court of law.
  
• They may not be called for jury duty.
  
• Representatives shall be granted free and unrestricted travel between their home, the Capital, and any area related to their work as a representative.
  
• Any Representative may speak in debate of a bill. If multiple Representatives wish to speak, they should attempt to alternate parties by order of seats gained in the Parliament, or by senority of term in the Senate.
  
• Any Representative, in debate, may call for a temporary cessation on recording of up to 15 min in a sitting session. During this period, no votes may be cast except the vote deciding if that cessation is to be granted, which can pass after a 3/5 vote. The vote to grant cessation, and the arguments of the member for cessation are private, as is any other discussion during this period.
  
• Any Representative, in debate, may refuse to yield their time for as long as they see fit. If they continue until past 2359 that day, they will begin speaking the next day and may continue the filibuster if they see fit as long as that Representative is present when at least 1/3 of their house is present. The filibuster may be ended if the Representative stops standing, eats, drinks, or does not speak for 30 seconds. A filibuster may be ended by a 4/5 agreement by the House. A 2/3 agreement by the House will end the filibuster but requires the issue to be tabled for 3 days.
  
• Any Representative, in debate, may call that the bill being discussed is unconstitutional. Upon such a declaration, the bill will be passed to the supreme Court. After a majority decision by them, the law will either be found unconstitutional, in which case it is forever tabled, and the proposing Representative may be removed by decision of the supreme court, or the bill is found constitutional, in which case the case is brought back, and the Representative who called for its unconstitutionality may be removed by a majority of the House.

Article 27, On the Responsibilities, Restrictions, and Duties of Representatives:

• Every Representative must appear in their respective house and vote on a bill or issue at least 60 days in a year, though their votes may be a deliberate abstention.
  
• Every Representative must be available, and contactable by their constituency, for discussions on policy or voting for some reasonable period of time on a regular basis.
  
• Every Representative must have a system for taking in suggestions from their constituency and incorporating them into their policies.
  
• No Representative may perform any paid work outside of being a Minister of the Cabinet during their elected period.
  
• No Representative may enter the other house, except after a majority approval by that house in extraordinary circumstances as a witness or in the case of the President in a budgetary discussion.

Article 28, On the Freedom of Speech and Communication:

• Any Citizen of the PDRM may express their thoughts or grievances in any way, as long as that expression does not meaningfully harm other people.
  
• The Republic may never place any restrictions on political discourse, non-violent protests, intellectual discussions, or any communication which does not cause or call for people to come to physical harm. The Republic may place restrictions on libelous or slanderous expression.
  
• Expression which is deliberately meant to call for physical harm towards some person, or group of people, or calling for any other illegal action, may be prosecuted against.
  
• A person may freely record their entire lives, not requiring the consent of any other party, except as outlined in Article 30
  
• Any voting age person may voluntarily give up some portion of their freedom of speech and communication in the form of a legally binding document, signed with a reliable, unbiased witness.

Article 29, On Lawyers and Judges:

• Any citizen may become a lawyer after passing an examination on legal matters in English and being of sound mind. Upon becoming a lawyer, they may represent any other person in court, brief a jury on legal matter, provide legal advice, draft contracts, act as a witness, carry out the will of the deceased, prosecute a suspect and appear as an expert legal witness. In addition, they will be called to vote for any vacant judicial position that appears, such as for a local or supreme court.
  
• A lawyer must renew their status as a lawyer every 5 years, passing a new examination on their understanding of current legal matters.
  
• A lawyer may become a judge after being a practicing lawyer for at least 3 years, and after putting their name in for election, and an instant runoff election by the lawyers of the PDRM.
  
• A judge may join the supreme court after being a practicing judge for at least 3 years, and, after putting their name in for election, wins an instant runoff election of all the lawyers in the PDRM, and is not vetoed by the Prime Minister or President.

Article 30, On Proper Jurisprudence:

• Every PDRM citizen has the right to free legal representation, and every lawyer must spend at least 10% of the time they spend on legal matters on free legal support. The lawyer for each case will be selected randomly, and unless conflict of interest can be shown, they shall be the representative of their client.
  
• Every person is to be considered innocent until proven guilty. The name, likeness, and other identifiable information about an accused person may not be published or publicized by any entity, unless specifically ordered by a judge for the purposes of gathering evidence for or against the defendant.
  
• No person can be forced or coerced into incriminating themselves.
  
• All interaction between a defendant or plaintiff and their representative is priveledged and may not be used in court or recorded without both parties consent.
  
• All interactions conducted between any person and any representative of the court must be recorded and available in full for the deciding party.
  
• A jury within the PDRM consists of at most 12 voting citizens. They must be of sound mind, not committed an indictable offence, not committed a summary offence in the past 10 years, not served on a jury in the past 6 months and be reasonable confidant of their ability to participate in the full length of the trial. They shall be selected from a pool of 24 random PDRM citizens. The defendant and prosecutor may each reject 1 each for any reason, and a further 3 each for potential bias or disqualification. The decision of a jury must be unanimous, unless they deliberate for more than 4 hours, in which case a majority of 10/12 is allowed. If a juror must be excused, dies, or is in any other way unable incapable of continuing, the trial will go on, as long as there are at least 9 remaining jurors.

Article 31, On Trials:

• In the case of a criminal trial, if the charge is an indictable offense, the deciding party shall be a panel of no less than 3 judges, unless the defendant chooses a trial by peers, in which case a jury shall be the deciding party of guilt, with a single judge passing the sentence.
  
• In the case of a criminal trial, if the charge is a summary offense, the deciding party shall be a single judge in all cases.
  
• In the case of a civil trial, the deciding party shall be a single judge, unless the defendant calls for a panel of 3 lay judges.
  
• In all cases, the maximums for any sentence are 30 years in prison with 10-year parole, 5 years probation, $100,000 fine, Community Sentencing totalling less than 3 years of 40-hour weeks, and/or unlimited restitutions. A life sentence may only be applied if the criminal has commuted high treason or murder, and even then, must have a maximum 15-year parole.
  
• Any decision by a court may be overturned by an appeal from either side confirmed by a higher court. The Supreme Court’s decisions may not be overturned.
  
• Criminal Law can never be applied retroactively, except in the case of reducing a sentence or penalty.

Article 32, On Property:

• The Property of a Citizen is inviolable. No Entity may deprive a person of their property except through taxation as established by law, or for compensation as specified by law.

Article 33, On Budget:

• Every Minister of the Cabinet shall submit a budget request for their Department at least 2 weeks before the scheduled budget meeting. This should contain a detailed breakdown of the needs of the Department, as well as a detailed internal budget. After this, the Parliament shall meet to discuss the budget for the upcoming year. Every Department shall have a reserved day for its own budget, and they shall be discussed in reverse order of scale of the previous year’s budget. After a budget has been approved by a majority, no changes can be made. The budget for each department will be presented and argued by the Minister of the Department, who can be accompanied by up to 2 members of staff of the Department, though they may not speak to the Parliament, only to the Minister. During the Budgetary discussions, the President may sit in on the meeting, and may veto a decision with less than 2/3 approval.
  
• If no budget can be agreed upon for a department after a single day of discussion, it will be tabled until the end of the currently scheduled budget days. If it cannot be agreed upon after 7 days of discussion, it will be given the same budget as the previous budget period and tabled until next year.
  
• Under extraordinary circumstances, the budgetary discussion may be postponed for a single day by a ¾ vote and the approval of the President and Prime Minister.
  
• Under extraordinary circumstances, a budgetary discussion may be held for a single department a second time earlier in a budgetary period. This must be approved by a 2/3 vote, and the resolved budget must also gain a 2/3 vote. The money for this budget may be generated from loans and/or by applying an indiscriminate percentage cut to every other department of up to 50% of their remaining funds for the year.
  
• The currency or resources required for the budget will be provided by the Senate, with loans providing that which cannot be generated through revenue. These loans will be automatically authorized upon completion of the budget and will be undertaken by the Ministry of the Treasury.
  
• Any left-over revenue will be invested by the Ministry of the Treasury first into payment of debt, then into high security bond.
  
• If a department overspends during their budgetary period and runs out of the funds necessary to perform its most simple actions, the minister must appear before the Parliament both to defend their departments actions and request an emergency loan.

Article 34, On Deadly Weaponry:

• No PDRM Citizen may use or possess a device whose express purpose is to harm other people or creatures.

Article 35, On International Treaties:

• The PDRM accepts and agrees to abide by as a sovereign state to the four Geneva Conventions of 1949, the Vienna Convention on Diplomatic Relations, the Convention on the Rights of the Child of 1989, the Chemical Weapon Convention of 1992, the Convention on the Elimination of all forms of Discrimination of 2034, the United Nations Convention against Transnational Organized Crime of 2000, the Biological and Toxin Weapons Convention of 1972.
  
• The PDRM may choose to sign or not sign any international treaty, regardless of external wishes, as a sovereign state.
