Introduction
It is not hard to detect that Civil and Human rights has taken a huge hit in Neonphage's America, those whom are aware of Constitutional Rights may notice the rigorous violation of almost every conceivable standard and right afforded to them. This is because in the Near future of the late 21st century, the document has fully been realized as a tool of control and is used to suppress and control the country rather then free and then regulate the government.
Status of Constitution
As of 2030, the legal document has largely been functionally rendered useless in terms of control the government. Most people are gravely ill-informed to such extend about this document that there is growing majority of American who have zero idea they even have a constitution to begin with. When it is relevant, it is the Supreme Court justifying and supporting the Neo Democratic Government and legalizing otherwise illegal practices and policies.
When it is shown, it is often a doctored version of the Constitution that seemingly legitimizes what the government is doin g, but anyone who is knowledgeable in history and America, would know this is a fake.
The Amendments and their current status and changes
The First Amendment provides that Congress make no law respecting an establishment of religion or prohibiting its free exercise. It protects freedom of speech, the press, assembly, and the right to petition the Government for a redress of grievances.
Status: Largely Nullified, Anti Government and Anti civil Speech is punished, serious expressions of anti authoritarian speech can and will get you summarily executed on the street as a traitor.
The Second Amendment gives citizens the right to bear arms, by technicality, it gives States the right to national Guard and affirms the right to formulate militia's. As a result, Your right to bear arms is made manifest
Status: Formally Nullified, While the right to Bear Arms persists in a legal and neglected Grey area. The National Guard and all Militia's of all sorts have been made illegal and are either disbanded or killed.
The Third Amendment prohibits the government from quartering troops in private homes, a major grievance during the American Revolution.
Status: Neglected, often overlooked
The Fourth Amendment protects citizens from unreasonable search and seizure. The government may not conduct any searches without a warrant, and such warrants must be issued by a judge and based on probable cause.
Status: Functionally Non existent, In Neonphage's America, Authorities can not only search and seize whatever they want without a warrant, but they can also keep whatever they want, for whatever reason.
The Fifth Amendment provides that citizens not be subject to criminal prosecution and punishment without due process. Citizens may not be tried on the same set of facts twice and are protected from self-incrimination (the right to remain silent). The amendment also establishes the power of eminent domain, ensuring that private property is not seized for public use without just compensation.
Status: Largely neglected, Only applies to privileged classes in varying degrees. The Poor are subject to speedy judgements, due Process is not required and property rights are not really a thing and compensation doesn't exist for many Americans.
The Sixth Amendment assures the right to a speedy trial by a jury of one’s peers, to be informed of the crimes with which one is charged, and to confront the witnesses brought forward by the government. The amendment also provides the accused the right to compel testimony from witnesses, as well as the right to legal representation.
Status: Neglected, Information can be and mostly will be withheld in the name of "National" or "Special Interests". The Accused only sometimes is provided their right to compel testimony from witnesses and depending on class and status, may not be given representation.
The Seventh Amendment provides that civil cases preserve the right to trial by jury.
Status: Preserved, but Juries are often stacked and influenced by big money and special Interests so it almost doesn't matter.
The Eighth Amendment prohibits excessive bail, excessive fines, and cruel and unusual punishments.
Status: Preserved, but only for Companies and those of "Special Status". A Poor Black Man can be fined 80 Million Dollars for a single crime and get Jail for life, for failing to pay up.
The Ninth Amendment states that the list of rights enumerated in the Constitution is not exhaustive, and that the people retain all rights not enumerated.
Status: Preserved
The Tenth Amendment assigns all powers not delegated to the United States, or prohibited to the States, to either the States or to the people.
Status: Actively Violated, The US Government has ---***ALL***--- of the power, and specifically Supreme President House has all of the power and can revoke delegations of power for any reason. Making him not just a Dictator but functionally a Monarch.
The Eleventh Amendment Makes states immune from suits from out-of-state citizens and foreigners not living within the state borders; lays the foundation for state sovereign immunity.
Status: Preserved, Bold of you to assume that average citizens can even begin to sue a state in the first place!
The Twelve Amendment Revises presidential election procedures by having the president and vice president elected together as opposed to the vice president being the runner up in the presidential election.
Status: Null, There has been precisely zero Presidential Elections since 2030 and Vice Presidents have been appointed by House, not elected. This is an "Emergency" Measure.
The Thirteenth Amendment Abolishes slavery, and involuntary servitude, except as punishment for a crime.
Status: Horrificly Violated, essentially Null. The Institution of Slavery is functionally restored and gains new slaves, namely minorities, specifically Black People through Imprisonment and companies use them to cut Production costs.
The Fourteenth Amendment Defines citizenship, contains the Privileges or Immunities Clause, the Due Process Clause, and the Equal Protection Clause, and deals with post–Civil War issues
Status: Preserved, How who gets the 'privilege' of being a citizen is only afforded to those born inside the cities, American born outside are deemed as Illegal Immigrants and automatically subject to punishment and Imprisonment.
The Fifteenth Amendment Prohibits the denial of the right to vote based on race, color or previous condition of servitude.
Status: Preserved but effectively useless as Class is what defines your right to vote, and worse yet that vote can be easily overthrown by Money and Vote rigging.
The Sixteenth Amendment Permits Congress to levy an income tax without apportioning it among the various states or basing it on the United States Census

The Seventeenth Amendment Establishes the direct election of United States senators by popular vote
Status: Preserved, Reinforced. Considered something of a Fluke, In 2045 the Government basically enforced that ***All*** Senators must be elected, representatives as well and ensured all leaders below the presidency must be elected. This is probably because of a lack of Presidential Elections and was in effort to sell the Narrative that they're still a Democracy.
It is also not hard to rig, sway and influence the conclusion of these elections so is it really an improvement?
The Eighteenth Amendment Prohibited the manufacturing or sale of alcohol within the United States
(Repealed December 5, 1933, via the 21st Amendment)
Status: Altered, re-ratified. The Amendment now Prohibits the selling of Alcohol outside of American Borders and eventually expanded to prevent all American Goods from leaving their Borders.
The Nineteenth Amendment Prohibits the denial of the right to vote based on sex
Status: Preserved, Once again Class defines your right to Vote.
The Twentieth Amendment Changes the dates on which the terms of the president and vice president, and of members of Congress, begin and end, to January 20 and January 3 respectively. States that if the president-elect dies before taking office, the vice president–elect is to be inaugurated as President.
Status: Semi Preserved, House and the Vice President has no Expiry date on their terms and can remain in power indefinitely. There was a change, in that the Amendment now also Prohibits Unwell and unsound Congressmen and women from serving. Only the 'Best' is allowed to serve and this how congress has less fortunate members removed from office.
The Twenty-first Amendment Repeals the 18th Amendment and makes it a federal offense to transport or import intoxicating liquors into U.S. states and territories where such is prohibited by law
Status: Altered, Now it is written as if it was always actually expanding the 18th and banned the export of American goods abroad, this was done to enable Neo America's extreme Protectionism against SATO and the Imperial Bloc.
The Twenty-Second Amendment Limits the number of times a person can be elected president.

The Twenty-Third Amendment Grants the District of Columbia electors in the Electoral College
Status: Null, There are no Presidential Elections, the College is just a fancy couch job that is a relic of a Formally Democratic Society.
The Twenty-Fourth Amendment Prohibits the revocation of voting rights due to the non-payment of a poll tax or any other tax
Status: Repealed, Repealed in 2031. Those who failed to pay their taxes, notably the poor had their rights revoked as a method of control and preventing the Green Party or any other party or reformist politician from every realistically winning an election.
The Twenty-Fifth Amendment Addresses succession to the presidency and establishes procedures both for filling a vacancy in the office of the vice president and responding to presidential disabilities

The Twenty-Seventh Amendment Delays laws affecting Congressional salary from taking effect until after the next election of representatives

New Amendments
The Twenty-Eighth Amendment Formally bans any Party that is not the Neo Democratic Party or the Republican Party, after 12 days of the Amendment existing, any still active minor party was imprisoned and punished for the crime of 'Sedition'.
Status: Preserved, It's possible it may extend to ban even the Republicans and truly make America a formal One-party state instead of a Informal one.
The Twenty-Ninth Amendment Banned any and all Religion within America, All churches were ordered to shut down or face persecution. This affected Islam and Judaism first. The Amendment also legalized arrests without warrants as a stealthy way of ensuring the arrests would go without issue.
Status: Preserved, The Government is looking to ban Corporatized religions such as White Evangelism and erase the last Relic of Legal Religion in America and ensure total and permanent control of the State for all Eternity.
The Thirtieth Amendment Legalized any form of punishment, from Internment camps to 'Permanent Indentured servitude' to Human experimentation and summary and swift execution in the name of 'National Interests'.
Status: Preserved, Congress is currently working to fully Legalize Slavery and erase all the special language masquerading the institution and simply go loud with their Pro-Slavery stance
The Thirty-First Amendment Placed most companies under total government jurisdiction and fully mixed business and state together, at the expense of competition, the Government now also protects corporate Interests over the people.
Status: Preserved, Government is looking at Total Nationalization to prevent the Agency of Companies from growing and instate total and complete control over the country.
The Thirty-Second Amendment Ratified in 2041, All States were erased and made into the 13 commonwealths, starting with Washington, Dixie, California, Middle States, British Columbia, Mexico, Panama, Puerto Rico, Cuba, Quebec, Manitoba and Alaska. The Commonwealths centralized Federal Power and essentially erased states rights as a concept.
