Legislative Policy Governing Immigration, Travel, and Cross-Territorial Regulation
Preamble
This document hereby establishes the
Nauquan Charter System (hereinafter referred to as "NCS"), a unified and enforceable framework for the regulation of immigration, visitation, and the movement of goods across the continent of Nauquan. The provisions herein address the dissolution of the Abericlase barrier and the resulting influx of foreign individuals and materials into the continent, with the intent of safeguarding territorial integrity, security, and resources while promoting equitable access and cultural exchange.
Article I: Purpose and Scope
Section 1: Purpose
1.1 The purpose of this document is to:
(a) Provide a standardized structure for the regulation of entry into Nauquan, ensuring that immigration, travel, and commerce are conducted lawfully;
(b) Preserve territorial sovereignty, cultural heritage, and environmental stability;
(c) Facilitate cross-territorial cooperation to address the challenges of increased immigration and integration.
Section 2: Scope
2.1 The NCS shall apply to all individuals, entities, and goods entering Nauquan from beyond its borders, as well as movements between its territories.
2.2 Territorial governments shall adopt, implement, and adapt the provisions of this framework to address regional needs while upholding the principles set forth in this document.
2.3 The NCS shall not interfere with the internal movements of individuals within a single territory unless specifically stated in territorial policy.
Article II: Charter Tiers and Documentation
Section 1: Standard Charter Categories
3.1 The following tiers of charters shall be issued:
(a) Resident Charter: For individuals seeking permanent settlement. Eligibility requires proof of housing, employment, or sponsorship.
(b) Work Charter: For individuals engaging in employment or trade within Nauquan. Eligibility requires proof of contractual obligations or employer sponsorship.
(c) Academic Charter: For individuals engaging in educational or research activities. Eligibility requires sponsorship by an accredited institution.
(d) Transit Charter: For individuals or goods passing through Nauquan without the intention of long-term residence.
(e) Diplomatic Charter: For representatives of foreign nations or recognized organizations.
Section 2: Documentation Requirements
3.2 All applicants shall provide the following:
(a) Verified proof of identity;
(b) Evidence of intent, such as employment contracts, educational admission letters, or transit plans;
(c) Compliance with mandatory health, magical, and security screenings.
Section 3: Charter Duration
3.3 Charters shall be issued for fixed durations, as follows:
(a) Resident Charters: Renewable every 5 years;
(b) Work Charters: Valid for the length of employment plus 3 months;
(c) Academic Charters: Valid for the duration of the academic program or research project;
(d) Transit Charters: Valid for up to 90 days, with a single renewal option;
(e) Diplomatic Charters: Valid for the tenure of the diplomatic assignment.
Article III: Enforcement and Oversight
Section 1: Central Authority
4.1 The Continental Council of Oversight (CCO) shall serve as the primary regulatory body for the implementation and enforcement of the NCS. The headquarters will be located in
Bundushur, The Floating City of Magic to enable all use of arcane resources available.
4.2 The CCO shall:
(a) Maintain a central registry of all charters issued across Nauquan;
(b) Review and approve territorial adaptations to ensure compliance with the NCS;
(c) Conduct annual audits of territorial enforcement efforts.
Section 2: Territorial Enforcement
4.3 Each territory shall establish a Charter Enforcement Office (CEO) responsible for the following:
(a) Processing charter applications and renewals;
(b) Monitoring charter compliance through inspections and investigations;
(c) Collaborating with the Magical Enforcement Authority (MEA) to address violations involving restricted practices.
Section 3: Penalties for Violations
4.4 Violations of the NCS shall incur the following penalties:
(a) Unauthorized Entry: Immediate detention and deportation, with fines up to 1,000 gold pieces;
(b) Charter Forgery: Revocation of privileges, fines up to 2,000 gold pieces, and a 10-year ban;
(c) Severe Violations (e.g., magical sabotage): Criminal prosecution, imprisonment, or execution, as determined by the issuing authority.
Article IV: Rights and Responsibilities
Section 1: Rights of Charter Holders
5.1 Charter holders shall have the following rights:
(a) Equal protection under territorial law;
(b) Access to public services;
(c) The right to appeal penalties or denials through the Continental Council or relevant judicial bodies.
Section 2: Responsibilities of Charter Holders
5.2 Charter holders shall be required to:
(a) Adhere to all applicable laws and regulations within the territory of residence or travel;
(b) Notify the appropriate enforcement office of any changes in employment, residence, or intent;
(c) Respect local customs, environments, and magical or alchemical practices.
Article V: Adaptation and Amendment
Section 1: Territorial Adaptation
6.1 Territorial governments shall have the authority to amend the NCS to address unique local concerns, provided such amendments do not contravene the overarching principles of this document.
Section 2: Amendment Process
6.2 Proposed amendments must be submitted to the CCO for review and require a two-thirds majority vote for approval.
Article VI: Implementation
Section 1: Effective Date
7.1 The NCS shall take effect immediately upon ratification by the Continental Council.
Section 2: Transitional Provisions
7.2 Provisional charters shall be issued to individuals already residing in Nauquan, with a validity of 1 year during which applications for standard charters must be submitted.
