Supreme Court
The Supreme Court is the judicial branch of the Federal Republic's government, it is the guardian of the constitution as well as the laws of the Republic and the highest court in the land. The decisions of the Supreme Court cannot be appealed and serve as case law for the entire justice system.
Structure
The federal judicial system is headed by the Registrar of the Republic who is appointed by the President of the Senate from the candidate chosen by the Office of the Federal Civil Service. He is responsible for taking care of the administration of the federal judicial system, archiving the decisions of all the federal courts and for appointing new judges of all federal judicial as well as for designated the Chief Justice of the Supreme Court.
Lower level
The federal courts are in charge of particular areas whose cases arrive at the federal level or if only this level can handle them like constitutional disputes. The ones which are appealed in these are then transferred to the upper level which renders a final decision. The federal tribunals follow the same principles with the difference that the cases handled are more related to administrative than criminal sanctions. Whether a court or a tribunal, they are composed of five judges who are appointed by the Registrar of the Republic from candidates provided by the Office of the Federal Civil Service. Unlike the higher level, the lower one cannot refuse cases and can also be requested in two cases. Both are either when another justice level case's arrives at the lower courts or this one requests a federal judgement since it considers that the case does not fall within its jurisdiction.
Upper level
Head of the federal judicial system, the Supreme Court renders the final verdict for all cases that arrive there, it must not seek to interpret the law or the constitution, but rather apply it. The Supreme Court has nine justices who are appointed for fifteen-year terms based on candidates provided by an independent commission to the Regsitrar of the Republic. The Supreme Court can be seized in the case of two situations, in both of them, the Supreme Court can refuse to hear. These are when a case appealed by the lower courts arrives at the Supreme Court and when the Registrar of the Republic seeks the opinion of the court on a particular matter. Whatever its verdict, it must be followed by all the actors concerned and the necessary changes must be put in place, including sometimes the invalidation of a law.
Parole Board
The Federal Parole Board is responsible for studying and ruling on the parole of inmates who have been convicted by a federal court. The board, made up of five justices, must decide whether the inmate can be released from prisons after completing his minimum sentence on criteria such as good behavior or the risk of reoffending. It is he who must determine whether this will be a total or conditional release, the constraints of which must be put in place by the other competent agencies.
Public Agenda
The aim of the Supreme Court is to enforce the constitution and the laws of the Republic in court decisions. These judgments also make jurisprudence on the lower courts and this one cannot render a decision in contradiction with an old decision of the Supreme Court.
Assets
The seat of the Supreme Court as well as the intermediate courts is located in the city of Shanghai on Earth. The building is located in the heart of the city and is spherical in shape with large bay windows at the main entrance. The rest of the building is quite flattened with decorative vegetation and white in color.
