Declaration of Rights and Restrictions

The Declaration of Rights and Restrictions is a legal document created by Rei Shai to ensure that his vision of the perfect NItadus would come to fruition. It outlines the freedoms of all creatures in Nitadus and the restrictions on authorities.

Purpose

It was created to ensure that all creatures within the country have an equal and fait chance at life. This was the vision of the first president of NItadus.

Document Structure

Clauses

This document is divided into two major sections as they title would imply, the rights that apply to all living creatures that walk the earth, and the restrictions that apply to any governing body within the country.

Publication Status

The document has been transcribed many times over to be shared with all who wish to see what the rights they have and the restrictions are upon their local government. There are even readings of it in public and in different languages to ensure that even those who are not literate can still understand their rights within the country.

Legal status

The document is the founding law upon which the Nitadian Government is based.

Background

This document was written by Rei Shai to ensure that his vision of the country would come to fruition and it has been upheld by every ruler ever since.

History

This document revolutionized interpersonal relations in Nitadus as there was no longer the possibility of discriminating against any person for any reason as there is powerful magic that will catch those who break the law. Since the creation of this document the economy in Nitadus was able to prosper as all creatures with skills flocked to the country so they could live their life without worrying about the consequences of their birth.

Public Reaction

There was general distaste at first when the document was published but soon many people began to see the merit of the system this document enforced. There are of course still many people who do not believe in the rights declared within the document but they are not able to publicly go against the declaration or they will be prosecuted.

Legacy

The document has only been in effect for 60 years so there is no way to determine the long lastin effects it will have on Nitadus

Term

It is set to be effective as long as Nitadus remains a country under it's current governing state.

Section One: The Rights of all Living Things

All rights set forth in this document are effective for any living creature that is deemed to be capable of complex thought no matter their origin. The rights are to be upheld by every citizen and resident of Nitadus less they face legal consequences as outlined in Section 3.

The following are the rights attributed to all living creatures who reside in Nitadus.

-No creature may be discriminated against based on their race

-No creature may be discriminated against based on their sex

-No creature may be discriminated against based on their species

-No creature may be discriminated against based on their beliefs religious or otherwise

-No creature may be discriminated against based on their sexual preferences or decisions

-No creature may be discriminated against based on their size or physical build

-No creature may be discriminated against based on their ability to perform a task unrelated to the matter at hand

-No creature may be discriminated against based on their identity or self expression

-No creature may be discriminated against based on their heritage or family history

-No creature may be discriminated against based on their previous actions unless found guilty of a criminal charge

Discrimination is classified as any of the following

-Being denied a serviceclass 1

-Being denied employmentclass 1

-Being denied entry to a locationclass 1

-Being denied a promotionclass 1

-Being criminally suspected without due reasonclass 1

-Being insulted using derogatory termsclass 3

-Being the target of violence or other criminal activityclass 2

Section Two: The restrictions of any governing body or authority

The following are restricted actions for any governing body

-Putting in place a law, regulation or rule that would force a breaking of any clause of section one

-Omitting truths from reports to the Nitadian Government or the members of the organization

-Sheltering a creature who has been prosecuted under the criminal code of Nitadus or any of its allies

-Engaging in large scale trade* without the authorization of the Nitadian Government

-Pretending to be a branch of an organization it has not made a proper agreement with**

*Large scale trade is defined as any trade where more than 5000GP worth of goods are exchanged over the course of one month (30 days)*
**The agreement to be a branch is in effect for one week (seven days) after it is officially declared no longer to be agreed upon**

Section Three: Punishment for breaking the law set forth by the Declaration

There are four classes of punishment for breaking the laws set forth by the Declaration

Class One

Any creature found guilty of a class one offence will be sentenced to one quarter of their species expected lifetime in prison. They are also subject to a fine from 50-200GP depending on the severity of the offence.
Any creature is found guilty of a class one offence a second time is then subject to a lifetime sentence in prison as well as fines from 100-500GP.

Class Two

Any Creature found Guilty of a class two offence will be sentenced to one tenth of their species expected lifetime in prison. They are also subject to a fine from 10-50GP depending on the severity of the offence.

Class Three

Any Creature found guilty of a class three offence will either be sentenced one onehundreth of their expected life time in prison or be fined 25GP.

Class Four

Any organization found guilty of disobeying any offence outlined in Section Two will be fined 500-10000GP based on the severity and will be subject to a criminal investigation to determine whether or not there is reason for it to be dissolved by the government. Any employees of an organization that was forced to disband will continue to recieve the wages they had received as members of that organization for 2 months(60 days) unless they are found to be partially responsible for the offence in which case they will charged with a Class Two offence. Any creature found to be primarily or fully responsible for the offence will be charged with a Class One offence.

Section Four: Restrictions on the government

The FOllowing are the restricted actions for any level of government in Nitadus including the federal

-Passing of any law that would break any right set forth in Section One

-Denying entry to the city/province/country based on any reason set forth in Section One

-Having a level taxation exceeding 25%*

-Passing of any law that would deny the ability of a creature to participate in the democratic process for any reason outlined in Section One

-Ordering a criminal investigation without legal precedent to do so

*Any level of taxation exceeding 20% will incur an investigation into the reason a high level of taxation is required, if none is found the body will be found guilty and required to lower the taxation rate*
